Small Claims Court
Court: Small claims cases are heard in the Conciliation Court of the District Court.
Claim Limit: Generally $10,00.00.
Answer Period: Defendant can file an answer within five days of the trial date, but need only do so if a counterclaim is being filed.
Attorney Representation: Minnesota permits attorneys to represent clients in small claims court.
Eviction Cases: Eviction cases cannot be filed in small claims court.
Jury Trial: Jury trials not permitted.
Statutes of Limitations (Minn. Stat. Ann. § 541.01 et seq.):
– Written Contract: 6 years
– Oral Contract: 6 years
– Personal Injury: 2 years
– Real Property: 6 years
– Personal Property: 6 years
