Small Claims Court
Court: Small claims cases are heard in the Superior Court, on the Small Claims Section, Special Civil Part.
Claim Limit: $3,000.00
Answer Period: Defendant may file an answer within 35 days of service, but only if a counterclaim is being filed.
Attorney Representation: New Jersey permits attorneys to represent clients in small claims court.
Eviction Cases: Eviction cases cannot be filed in small claims court.
Jury Trial: Permitted only if the defendant files a demand at least five days before the return of the summons.
Statutes of Limitations (N.J. Stat. Ann. § 2a:14-1 et seq.):
– Written Contract: 6 years
– Oral Contract: 6 years
– Personal Injury: 2 years
– Real Property: 6 years
– Personal Property: 6 years
