Court: Small claims cases are heard in the District Court, Small Claims Division.
Claim Limit: $5,000.00
Attorney Representation: Not permitted (although if the defendant wants an attorney then he can request that the case be transferred to the regular docket).
Eviction Cases: Eviction cases cannot be filed in small claims court.
Jury Trial: Jury trials are not permitted, except on appeal.
Statutes of Limitations (Va. Code Ann. § 8.01-228 et seq.):
– Written Contract: 5 years
– Oral Contract: 3 years
– Personal Injury: 2 years
– Real Property: 5 years
– Personal Property: 5 years
