Arizona Small Claims Court
Court: Arizona residents file small claims cases are filed in their local Justice of the Peace Court.
Claim Limit: $2,500.00
Answer Period: Defendant must file an answer to the complaint within 20 days.
Attorney Representation: Only permitted if both parties agree in writing.
Eviction Cases: Eviction cases cannot be filed in small claims court.
Jury Trial: Jury trials not permitted.
Statutes of Limitations (Ariz. Rev. Stat. Ann. § 12-541 et seq.):
– Written Contract: 6 years
– Oral Contract: 3 years
– Personal Injury: 2 years
– Real Property: 2 years
– Personal Property: 2 years
