Small Claims
Court: Small claims cases are heard in the Magistrate Court.
Claim Limit: $15,000.00
Answer Period: Defendant can file an answer within 30 days, or appear at the trial.
Attorney Representation: Attorneys are permitted in small claims court.
Eviction Cases: Eviction cases can be filed in small claims court.
Jury Trial: Jury trials are not permitted in Georgia small claims court.
Statutes of Limitations (Ga. Code Ann. § 9-3-20 et seq.):
– Written Contract: 6 years
– Oral Contract: 4 years
– Personal Injury: 2 years
– Real Property: 4 years
– Personal Property: 4 years
