Small Claims Court
Court: Small claims cases are heard in the Small Claims Court.
Claim Limit: $10,000.00
Attorney Representation: Illinois permits attorneys to represent clients in small claims court (corporations must have an attorney)
Eviction Cases: Eviction cases can be filed in Illinois small claims court.
Jury Trial: Either party may demand a jury trial. The plaintiff must make the demand when filing suit; the defendant must make the demand within five days of being served, or at mediation/pretrial conference.
Statutes of Limitations (735 Ill. Comp. Stat. 5/13-201 et seq.):
– Written Contract: 10 years
– Oral Contract: 5 years
– Personal Injury: 2 years
– Real Property: 5 years
– Personal Property: 5 years
