Small Claims
Court: Colorado residents file small claims cases in the Small Claims Division of the County Court.
Claim Limit: $7,500.00
Answer Period: Defendant can file an answer any time on or before the trial date.
Attorney Representation: Attorneys can appear if they are a party to the action or if they are a full time employee or corporate officer of a party. If one party is permitted to have an attorney, the other side can be represented by one as well.
Eviction Cases: Eviction cases cannot be filed in small claims court.
Jury Trial: Jury trials not permitted.
Statutes of Limitations (Colo. Rev. Stat. § 13-80-102 et seq.):
– Written Contract: 6 years
– Oral Contract: 6 years
– Personal Injury: 2 years
– Real Property: 2 years
– Personal Property: 2 years
