Court: Small claims cases are heard in the Magistrate Court.
Claim Limit: $5,000.00
Answer Period: Defendant must file a written answer answer or make an appearance within 20 days of service.
Attorney Representation: Attorneys are permitted in small claims court.
Eviction Cases: Eviction cases can be filed in small claims court.
Jury Trial: Jury trials are not permitted.
Statutes of Limitations (W. Va. Code § 55-2-1 et seq.):
– Written Contract: 10 years
– Oral Contract: 5 years
– Personal Injury: 2 years
– Real Property: 2 years
– Personal Property: 2 years
